In March, Kaiser sent a letter to the ERCB stating they have exhausted all alternative locations without success and request the ERCB make a determination of the review application of the original location that was planned behind London Drugs & Wal-Mart in our community.
The ERCB replied to Kaiser, City of Calgary and RRROCA that they will decide on the deposition of the review application after April 02, 2013.  There are two potential stages of this process by the ERCB.
Stage one: ERCB determines whether to review the original decision of the application.  If the ERCB decides not to review the decision (application), the process is finished and there is no other recourse with the ERCB allowing Kaiser to proceed in the original location.
Stage 2: If the ERCB decides to review the decision of the applications, it almost always becomes a public hearing.  At this point, the legal firm retained by RRROCA and the City of Calgary legal department would represent us at the hearing.
On April 02nd, Kaiser submitted a request to the ERCB to continue to hold off on their decision as certain government officials have initiated further efforts to determine whether an alterative surface location for the well can be agreed to.
We were waiting for the ERCB’s reply and if there is a resolution of an alterative surface location that meets all stakeholders concerns.
